In Attendance: Trustee Don Minton, Trustee Dave Phares, Trustee Nancy Brown, Fiscal Officer Stacey McKenzie, Chief Jacob King, Deputy Nick Moody, and Township Coordinator Rhonda Ledford

Announcements: Rhonda Ledford brought to the attention of Trustees that the flag at the Fire Station is tattered.  We will order a new one from the American legion.     

Citizen comments relating to agenda items:  

 21-06-22-01 Trustee Don Minton moves to accept the agenda.  Second by Trustee Nancy Brown.  R/C:   All ayes.

21-06-22-02 Trustee Don Minton moves to pay the bills, check numbers 64969 through 65011 and ACH payments 705-2021 through 732-2021 in the amount of $34,955.34.  Second by Trustee Nancy Brown. R/C: All ayes.       

21-06-22-03 Trustee Nancy Brown moves to dispense with reading and accept the minutes from the regular meeting of June 8, 2021.  Second by Trustee Don Minton. R/C: All ayes.

 OLD BUSINESS

Administration

Discussion with Ethan Harris and Beau Thompson regarding the Joint Economic Development District (JEDD) agreement.

In attendance were Commissioner Lowell McGlothlin, Ethan Harris,  

The discussion was started by Ethan Harris regarding the final draft presented to Clark County and Bethel Township by the City of Huber Heights.   The draft does not discuss the annexation in which Huber Heights would agree not to annex any part of the surrounding area of the current Old Dominion Trucking facility currently being built.  Huber Heights says this is their final offer and the township trustees did not accept it.  There were discussions by Bethel Township and Clark County to hire their own attorneys which specializes in JEDD agreements.  Clark County will present this to the City of Huber Heights and let them make the final decision, currently there is not water or sewer being made available to the trucking terminal by Clark County. Commissioner Lohnes says we will be getting a letter giving us until June 2nd to either take it or leave it on the JEDD, without the no-annexation agreement. 

NEW BUSINESS

Administrative 

Warren Davidson’s District Director Ben Thaeler would like to return to having a monthly meeting at the township offices on the 4th Tuesday of the month from 3:30PM to 4:15PM.

The Trustee agreed to let Ben Taeler use the township building conference room for this. Rhonda Ledford will contact him to arrange.  

At the OTA meeting on Wednesday, they were asking for someone to host the fall meeting.  Is there any interest in doing so and if yes…who would be our speaker or topic? No action was taken.  Rhonda Ledford will contact and see if anyone has stepped up to hold the meeting.

21-06-22-04 Trustee Nancy Brown moves to adopt Street Light Assessments for 2022, to be billed for the year January 1, 2022. Second by Trustee Don Minton.  R/C: All ayes.

21-06-22-05 Trustee Nancy Brown moves to declare each of the following properties a separate nuisance to be abated:  Second by Trustee Dave Phares. R/C: All ayes.

1030 Bookwalter Dr. Old cars that look to be on neighbor’s property. No license.

25 Andrews Lane New Carlisle. Tall grass, Debris in yard, old swimming pool with water in it, people living in camper beside house, and they are operating a business called Mother-Daughter Duo out a shed that has been built on to their house.  I have turned this over to Clark County to check to see if permits were issues for shed. Electric cords running from double wide to old camper on the premises. We will send letter on tall grass however the other issues will be turned over to Clark County.

Apple Creek Apartments (Behind Mel-O-Dee) New Carlisle, Complaint came from a neighboring house.  States there is always furniture out by the dumpster, and at times it is there for a month.  The complaining party stated that there is always stuff hanging off the porches and it makes the whole complex look bad.  We will send a letter but can not do anything about balcony uses.

115 Slayton. Two trucks have been in this yard for several years. Complainant said she has called for the past couple of years, and nothing has been done.  

113 Middle St. Older cars with no license or engines, very aggressive pit bull lives at this house.

103 West St Medway. This has been a nuisance problem property for several years.  Owner has been asked several times to clean up. Has been blue tagged by Deputy in 2020 and now in 2021.  Now has goats and ducks in the yard.  He states that he is allowed to have.  The neighbors are complaining of rodents.  He has no trash service. If he does not clean up what is our next step?

I have asked for Clark County’s help with this location due to animals and rodents.

Kolby Watson with TK-Elite charged the township $200.00 for each of the following properties.  851 Corvette, 365 Weinland Dr and 12086 LVP. Now that we have hired two new people can our road crew take on mowing some of our nuisance properties. Our road department cannot legally do this job because of bonding and insurance purposes.

06/17/2021 Spoke with Dave Alexander, the property manager of the Martin Chevrolet building.  I informed him we had had several calls pertaining to the way the building looks, and this was his reply:

  1.  If there are code violations, send him a letter. (Not a secure building. Gate unlocked and boards off several windows)
  2. There are still people entering the building, so he is not interested in taking the glass off the front of it for fear of the new windows being broke.  
  3. The building is up for sale but not listed with a realtor at this time.  The cost is $650,000.00. 
  4. I took pictures of this property today and it is not a secure property. Windows are broken which would allow access and the gates are unlocked.

21-06-22-06 Trustee Don Minton moves to pass the newly revised Resolution of Necessity to be filed with the Clark County, OH auditor for a 2 MIL renewal levy that was in effect from 2017 to 2021 for the Bethel Township, Clark County Fire Department. This was previously accepted on 06/08/2021.  Second by Trustee Nancy Brown.  R/C: All ayes. This shall be known as F1) 

21-06-22-07 Trustee Dave Phares moves to pass a newly revised Resolution of Necessity to be filed with the Clark County, OH auditor for a 2 MIL renewal levy that was in effect from 2017 to 2021 for the Bethel Township, Clark County Fire Department. This was previously accepted on 06/08/2021.  Second by Trustee Don Minton.  R/C: All ayes. (This shall be known as F2)

21-06-22-08 Trustee Nancy Brown moves to pass a newly revised Resolution of Necessity to be filed with the Clark County, OH auditor for a 2 MIL renewal levy that was in effect from 2017 to 2021 for the Bethel Township, Clark County Fire Department.  This was previously accepted on 06/08/2021.  Second by Trustee Dave Phares.  R/C: All ayes. Road  

We had a call about the apron that is in front of a house on McAdams St.  The apron is in very bad shape.  Is it her responsibility or ours to fix? The apron is the part that is between the sidewalk and the street and is the responsibility of the homeowner.

21-06-22-09 Trustee Don Minton moves to pass a resolution for the fiscal officer, Stacey McKenzie to transfer appropriations within the 2021 road fund to accommodate the hiring of two new full time road employees.  Second by Trustee Dave Phares.  R/C: All ayes.

That there be transferred within the 2031 Road Fund to the line item entitled Other – Salaries (2031-330-190-0000) the sum of $30,000.00, Ohio Public Employees Retirement System (2031-330-213-0000) the sum of $3,000.00, Medicare (2031-330-213-0000) the sum of $1,000.00, and Medical/Hospitalization (2031-330-221-000) $25,000.00, totaling $59,000.00 from the line item entitled Other-Other Expenses (2031-330-599-0000).

We will have to set up an Ohio EPA account for future reports of storm water and MS4 reports. This is required by the Ohio EPA and is called the Notice of Intent application. We will Co-Permit with Clark County. All Trustees have a copy of the form on your desk.

Police 

21-06-22-10 Trustee Nancy Brown moves to pass a Resolution of Necessity to be filed with Clark County, OH. For a 1.75 MIL Police levy to be on the ballot in 2021 and in effect from 2022 to 2026.  Second by Trustee Don Minton.  R/C: All ayes.
